Consell de Formentera calls for withdrawal of draft amendment to Coastal Authority's general regulations

foto 2022 CostesToday Ana Juan, President of the Consell de Formentera, sat down with Maria Jose Mayans, Chair of the Platform for Individuals Affected by Delimitation (Plataforma d'Afectats per la Delimitació, PAD), and PAD Spokesman Vicent Tur, to review the local government's representations to the Ministry of Ecological Transition and Demographic Challenge about proposed changes to Coastal Authority regulations, including a request that the proposal be scrapped. An order signed 7 January by President Juan detailed these representations and maintained that the amendment submitted for public consultation was "unlawful and contrary to the case law on delimitations" and "creates legal uncertainty which encroaches on the rights of individuals".

The President stressed that the new regulations must take into account "the peculiarity of Formentera" and that "no backward steps can be taken in this regard". "The people of Formentera have always worked together on this issue and transcended partisanship to defend each others' interests; the new regulations must not increase insecurity or impinge on our powers as a local authority", said Juan, who stressed "the great work of department staff" in preparing the representations.

The document sent by the Consell highlights how the proposed modifications would mark a return "to arbitrariness in determining the scope of public domain" and encroaches on municipal government's authority in town planning and activities. For example, it regulates construction that can be carried out in protected areas and modifies articles that regard conservation works on properties left in the public maritime land domain. "Care must be taken so that these changes don't lead to built structures in this coastal area being demolished earlier than previously accorded", the text reads, highlighting the amendments' potential "to cause significant impact on the landscape and environment".

The modifications would additionally cause "unjustified limitation of the rights of individuals insofar as the changes, in their laxness, leave review of demarcation to the subjectiveness of the Administration, and once again ignore technical criteria accepted by jurisprudence". In addition, the changes may raise "new obstacles to owners' and others' rights in the public land maritime domain".

Absent from the proposed regulations is the section which currently allows individuals to park and drive in the area in question. "In any case, the change stands to create significant environmental concerns and complications in how access to beaches is managed by regional and local authorities, even engendering problems in town planning".

One of the proposed modifications involves limiting concessions to a duration of 30 years, or up to 75 years if renewed, as set out in legislation on "public administration patrimony", which creates provisions for a generic period of 75 years.

Nor does the proposed regulation include an economic impact study, or equivalent mechanisms, which the Formentera government's representations describe as "a fundamental requirement in state legislation" and necessary for the economic quantification of the proposed measures' impact.

Formentera unveils renters’ clause to curb house parties, support owners of holiday rental properties and advocate for their legal stability

cartell 2021 clausulaThe Formentera Departments of Tourism Planning and Interior are pleased to offer owners of vacation rentals a clause which aims to tackle disturbances and conduct that is at odds with Covid-19 protocol. The document highlights current restrictions on social gatherings in domestic spaces, including the ban on parties, and asks tourists to pledge to comply with rules, informing them that violators risk immediate nullification of their rental agreement. Renters are also asked for details about other houseguests, with co-renters subject to applicable fines.

“This document is intended to educate tourists when they first get here so that they know their obligations”, said President Ferrer. “Plus it creates legal support for property owners and law enforcement agencies so they can act faster and coordinate their response”.

The document will be sent to tourist boards, estate agencies and tour operators, and can be downloaded in Catalan, Spanish and English from the Covid section of the Consell de Formentera website, sub-section ‘Covid Clause - Rentals’.

Last week a list of vacation rental properties, together with the names and telephone numbers of the people and tourism businesses who own them, was delivered to Formentera Local Police in an effort to improve local law enforcement’s response to house parties. Ferrer said that the new document, which she described as “a step forward” and “clear progress”, would also mean expanded collaboration.

Signed documents are sent to FLP so that, if need be, a fine can be issued. Owners will also receive assistance as necessary from law enforcement in making renters vacate the premises.

Formentera makes starting a business and declaring economic activity simpler and cheaper

cartell 2021 us ho posamThe Formentera Department of Land is pleased to present “Us ho posam més fàcil” (We’re making things easier) — a campaign to make declaring new commercial activity easier and less expensive through year’s end 2021. Said department chief Rafael González, “We’re making it easier, faster and cheaper to start a new business or declare commercial operations”.

Business made simpler
Today, Formentera’s full catalogue of municipal services can be processed online with the Virtual Citizen Information Office (OVAC), and a declaration of responsibility and technical documentation are all that is required to start a new business or declare existing activity. The changes make it simpler and faster to process permits, with go-ahead becoming official 24 hours after registration of a request..

Lower fees
In another key change that will remain in effect even after the end of Us ho posam més fàcil, islanders pay less for simple formalities like business sales or changes of ownership. The latter, for example, will now carry a fixed fee of €200 — a nearly 90% reduction on the standard rate.

Fee rebate
Local government will also subsidise 50% of fees applied to new commercial activity for the duration of the campaign. González called it a “leg-up” for crisis-hit islanders starting a new business.

Consulting
FDL has introduced a consultation service for regular islanders and professionals alike. Queries can be directed to activitats@conselldeformentera.cat.

Municipal employees will perform door-to-door visits of local businesses and deliver brochures explaining the new measures. Industry professionals will also be invited to info-sharing meetings where related developments will be detailed.

‘Formentera, every corner counts’: 137 upgrades and beautification projects and €1m-plus in investment

foto 2021 cada raco BThe Formentera Department of Land is pleased to present its appraisal of “Formentera es cuida a cada racó” (Formentera, every corner counts). Department chief Rafael González gave a positive assessment of the campaign, which, from November to 30 April, saw islanders carrying out 137 projects to improve or beautify areas of the island.

González described the pandemic relief initiative, which logged €1,039,051 in total investment, as “an image-enhancement success” and, considering associated activity for islanders employed in construction, painting and maintenance, “a boost for the local economy”.

Simplified subsidy requests
To encourage improvements, the island’s government made requesting permits easier and subsidised planning fees and taxes, reducing one related tax by 95% (the legal limit) and eliminating fees and the public thoroughfare occupancy tax outright. All told, islanders and hometown businesses have seen savings of €42,342, with what would typically be €44,160 in fees and taxes reduced to just €1,818.

González insisted that, heritage sites aside, simplified permit requests were here to stay. Under new rules, plans to carry out upkeep and uprades must be communicated to the OAC (Citizen Information Office) and OVAC (Virtual Citizen Information Office) 24 hours in advance, or ten days in advance for work not involving expanded square metres.

Es retarda al 15 de maig l’aplicació de l’ordenança que prohibeix la realització d’obres que ocasionin molèsties als nuclis urbans i zones turístiques

El Consell de Formentera, a través de l’àrea de Territori, informa que el 15 de maig entrarà en vigor l’ordenança de remors i vibracions que prohibeix la realització d’obres que puguin ocasionar molèsties als nuclis urbans o zones turístiques. Habitualment l’ordenança està en vigor entre l’1 de maig i el 15 d’octubre, segons ha recordat el conseller de l’àrea, Rafael González, que ha destacat que “aquest any l’hem posposat 15 dies, ja que l’inici de la temporada turística també s’ha retardat, i així permetem que es continuï fomentant l’economia local i que es puguin finalitzar certes obres que també a causa de la crisi originada per la covid han pogut patir retards”.

Recordam que cada temporada en els nuclis urbans o zones turístiques només es poden executar les obres que no ocasionin molèsties tals com remors i vibracions que normalment són produïdes per excavacions i construccions de fonaments i estructures. També queda prohibida l’ocupació de via pública amb bastides.

D’altra banda, cal destacar que sí que es podran realitzar obres menors o interiors que no ocasionin molèsties al veïnat i d’altres motivades per la reparació d’avaries en les conduccions existents que han de ser solucionades per motius de seguretat i/o salubritat, o obres urgents que no admetin dilació, amb sol·licitud prèvia que s’haurà d’analitzar i resoldre, cas per cas, per part del Consell.
